Next Steps

1. This property is being offered with no representations or warranties, either written, digital, or verbal, either express or implied. While the Seller believes the information contained in the listing services, printed materials, and digital media is correct, it is incumbent upon the Buyer together with their agents, advisors, and employees to perform their own due diligence in all matters.  Caveat emptor.

 

2. The Seller of the Property is the Society of the Divine Word, which is a Catholic religious order. As such, certain procedures must be followed in the process of this sale in order to comply with Canon Law.

 

3. As the Seller is a religious organization, and one that is concerned with its legacy in the town of Duxbury, The Seller will request that certain deed restrictions run with the property regarding future use, as follows: 

 

For a period of 90 years from the date of this deed the parties agree as follows:

 

Grantee agrees and covenants it will not use, permit others to use or lease or otherwise transfer the use of the subject Property or any

portion thereof to any person who uses or will use the Property or any portion thereof as a facility in which research, performance, advocacy

or counseling in favor of any of the following are conducted:

(1) Abortion; (2) Sterilization; (3) Experimentation on human embryos; (4) Stem cell research; (5) Destruction of human embryos; (6) Human

cloning; (7) Euthanasia; (8) Assisted Suicide; (9)  Death by means other than natural causes.

 

Grantee further agrees and covenants it will not use, permit others to use or lease or otherwise transfer the use of the subject Property or any portion thereof to any person who uses or will use the Property or any portion thereof as a facility in which: (1) Pornographic media are displayed, sold, or rented; (2) Other adult entertainment is offered such as an adult bookstore, x-rated movie theater, topless bar, or similar type establishment; (3) tobacco or cannabis is cultivated; or (4) firearms are sold.


4. While a 2% co-broke is being offered by the Seller to Buyer Agents, we anticipate that there will be multiple offers and  some agents may choose to forego the offer of co-broke and look to their clients for compensation in order to increase the competitiveness of their offer. Therefore, please be specific and clear in your offer if you intend to accept or decline the offer of co-broke so that the Seller can accurately determine and then compare the bottom line of all offers.
